Agreement to our terms

We are NextWine ("NextWine", "we", "us", or "our"). We operate the website at https://www.nextwine.net and the related features (the "Services"). You can contact us by email at support@nextwine.net.

By accessing or using the Services, you agree to be bound by these Terms of Use. If you do not agree, you must not use the Services. The Services relate to wine and are intended only for users who are at least 18 years old.

We may update these Terms from time to time. Changes are effective when we post the updated version and revise the "Last updated" date above. Your continued use of the Services means you accept the updated Terms.

1. Our services

NextWine helps you discover wines, take quizzes, save favourites to a wishlist, and generate personalized wine recommendations, including recommendations created with artificial intelligence. The Services are provided for information and personal, non-commercial use. We are a discovery and recommendation platform - we do not sell, supply, or deliver wine or any other alcoholic beverages.

2. Intellectual property

We own or license the software, design, text, graphics, and other content that make up the Services, as well as the NextWine name and logo. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use. You may not copy, reproduce, republish, scrape, or otherwise exploit any part of the Services for commercial purposes without our prior written permission.

3. Your account

To use certain features you sign in with your Google account. You are responsible for the activity that happens under your account and for keeping access to your Google account secure. You agree that the information associated with your account is accurate and that you will keep it up to date. We may suspend or terminate accounts that violate these Terms.

By using the Services you confirm that you are at least 18 years old, that you will use the Services only for lawful purposes, and that you will not access the Services through automated means or attempt to disrupt or reverse engineer them.

4. Credits, payments, and AI usage

  • Some features - in particular AI-generated recommendations - consume credits. New accounts receive a limited number of free credits.
  • You can purchase additional credits through our payment processor, Stripe. Prices are shown before purchase. We do not store your full payment card details.
  • Credits are tied to your account, have no cash value, and are non-transferable. Except where required by law, purchased credits are non-refundable.
  • Use of the AI feature is subject to usage limits (for example, a cap on the number of generations per hour) to keep the Services available for everyone.
  • We may change pricing, credit allocations, available plans, or usage limits at any time. Changes do not affect credits you have already used.

5. AI-generated content

Recommendations and related content produced by the AI feature are generated automatically using a third-party AI provider (OpenAI) based on the prompt you submit. AI output may be inaccurate, incomplete, or out of date, and is provided for general informational purposes only. It is not professional, medical, or purchasing advice. You are responsible for the prompts you submit and must not submit unlawful, infringing, or otherwise objectionable content. Always drink responsibly and in accordance with the law in your jurisdiction.

6. Feedback and submissions

If you send us questions, suggestions, or other feedback about the Services, you agree that we may use that feedback for any purpose without restriction or compensation to you. You confirm that your submissions are your own and do not infringe the rights of any third party.

7. Prohibited activities

As a user of the Services, you agree not to:

  • use the Services for any unlawful purpose or in violation of these Terms;
  • systematically retrieve or scrape data from the Services to build a collection, database, or directory without our written permission;
  • interfere with, disrupt, or place an undue burden on the Services or connected networks, or attempt to bypass usage limits or security-related features;
  • access the Services through bots, scripts, or other automated means, except standard search engine indexing;
  • attempt to decipher, decompile, disassemble, or reverse engineer any part of the Services; or
  • impersonate another person, misuse our support, or harass other users or our team.

8. Services management and availability

We may monitor the Services for violations, take appropriate action against anyone who breaches these Terms, and manage the Services to protect their proper functioning. We may change, suspend, or discontinue any part of the Services at any time without notice, and we cannot guarantee uninterrupted availability. We are not liable for any unavailability, interruption, or for loss or corruption of data, so you are responsible for keeping your own records where needed.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we handle your personal information. By using the Services, you agree to that policy.

10. Termination

These Terms remain in effect while you use the Services. We may suspend or terminate your access at any time, without notice, if you breach these Terms or applicable law. You may stop using the Services and delete your account at any time. Provisions that by their nature should survive termination will continue to apply.

11. Disclaimer

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Services or any content - including AI-generated recommendations - will be accurate, reliable, or error-free. Your use of the Services is at your own risk.

12. Limitation of liability

To the fullest extent permitted by law, NextWine will not be liable for any indirect, incidental, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising from your use of the Services. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold NextWine harmless from any claims, losses, or expenses arising out of your use of the Services, your breach of these Terms, or your violation of the rights of any third party.

14. Governing law and disputes

These Terms are governed by the laws applicable in the place where the Services are operated, without regard to conflict-of-law rules, and subject to any mandatory consumer protections available to you in your country of residence. If you have a concern or dispute regarding the Services, please contact us first at support@nextwine.net so we can try to resolve it informally.

15. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
